Terms of Use
This English text is a convenience translation. For consumers in Germany the German version is legally binding. Read the German version
The rules for using the Clearing apps and this website. Pledges have their own Pledge Terms.
1. Scope
These Terms of Use apply to the Clearing apps for iPhone, iPad and Mac and to the website useclearing.com, provided by WKSolutions GbR, Siedlungsweg 24, 37124 Rosdorf, Germany (“we”). For pledges, our Pledge Terms apply in addition and take precedence. How we handle data is explained in our Privacy Policy.
2. The service
- Clearing is free. There is no subscription and there are no in-app purchases. Every feature works without a pledge: Screen Time shields, the Clearing DNS filter, the Mac filter, check-ins, the panic button and the lessons.
- A pledge is optional. It is governed by the Pledge Terms. It unlocks no features and buys no digital content.
- Protection and verification need permissions that only you can grant on your device: Screen Time access, the DNS settings, the Mac system extension and notifications. Without them some features don’t work.
3. Age
Clearing is for adults. You may only use the apps if you are 18 or older.
4. Account
- You can use protection without an account; the app then works with a random installation ID. For pledges and for protecting more than one device you need an account, created with Sign in with Apple.
- One account belongs to one person. Keep your devices and your Apple ID secure.
5. What you may and may not do
- Use Clearing only for yourself and only on devices that you use yourself.
- Don’t use Clearing to monitor another person. Installing it on someone else’s device without their knowledge is not allowed and may be illegal.
- Don’t manipulate the verification, for example by faking signals for another account, and don’t misuse our forms.
- Don’t decompile or reverse engineer the apps, except where the law allows it.
6. What Clearing can’t promise
- No blocker catches everything. New sites, other networks, VPNs or devices without Clearing can get around protection.
- Clearing is not a medical product and not a treatment. It does not replace professional help. If you are in crisis, see our helplines.
- We can’t promise a particular result. Staying clean is your achievement.
7. Availability and changes to the service
- We work to keep Clearing available, but we cannot guarantee uninterrupted operation.
- We may change or extend features. Because the service is free, we may also discontinue it with reasonable notice.
- If we discontinue the service while pledges are running, all active pledges end without a charge.
8. Liability
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.
- For slight negligence we are only liable for breach of an obligation that is essential to the contract and on which you may rely (cardinal obligation), limited to the damage typical for this kind of contract and foreseeable when it was concluded.
- Otherwise our liability is excluded. These rules also apply to our staff and agents.
9. Ending use and deleting your account
- You can stop using Clearing and delete the apps at any time.
- During a pledge, deleting the app removes protection from that device. This is handled under the Pledge Terms (section 6): we notify you and you have 24 hours to restore protection.
- You can delete your account in the app under Settings. If a pledge is active, we tell you your options (withdrawal within 14 days, hardship release) and carry out the deletion once the pledge has ended, because we need the data to run it. Requesting deletion never triggers a charge.
10. Apple-specific terms
If you obtained the app from Apple’s App Store, the following also applies:
- These Terms are agreed between you and us only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the app and its content.
- Your licence to use the app is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions. Apple’s Licensed Application End User License Agreement applies to the licence, unless these Terms give you more rights.
- We alone are responsible for maintenance and support of the app. Apple has no obligation to provide any.
- To the extent a statutory warranty applies, we are responsible for it, not Apple. If the app fails to conform to an applicable warranty, you can notify Apple, and Apple will refund the purchase price, if any; the app is free. Apple has no other warranty obligation regarding the app.
- We, not Apple, are responsible for addressing any claims by you or third parties relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
- Questions, complaints or claims about the app go to us: WKSolutions GbR, Siedlungsweg 24, 37124 Rosdorf, Germany, [email protected].
- When using the app you must comply with applicable third-party terms, for example your mobile network.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple may enforce them against you as a third-party beneficiary.
11. Forms on the website
The withdrawal, appeal and status forms on this website send what you enter to our backend in the EU. If our backend is not reachable, the form opens your email app instead. See the Privacy Policy.
12. Changes to these Terms
If we change these Terms, we show you the new version in the app. Changes only apply to you once you accept them. Running pledges keep the Pledge Terms you accepted.
13. Final provisions
- German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in another country, its mandatory consumer protection rules still apply to you.
- We are not willing or obliged to take part in dispute resolution proceedings before a consumer arbitration board.
- If a provision of these Terms is invalid, the rest remains valid; the statutory rules apply instead.
